A Customs officer replies to Malaysia Today on charges to ex-JB OCPD

Zakaria Chek was involved and so was the then Johor Bharu OCPD, Dato Rahim, who was charged along with a group of around eight police officers who operated from an office in Jalan Meldrum preparing the auction documents.

Hi Pete,

I refer to your article in No Holds Barred entitled ‘About sex and bribery’ and think you got the facts about the Zakaria Chek case on the car smuggling syndicate somewhat wrong.
For you kind information, the Customs Department was not involved in this scam. In fact, much to our exasperation, we were impeded in our investigations.

I was personally involved in the investigation of the case as part of a special task force in 1991. We single-handedly cracked the case after obtaining information from a confidential informant. It was only after we started confiscating the cars -- most of which were Honda Accords -- that the Anti-Corruption Agency (ACA; now MACC) approached us and said that they wanted to take-over the investigation.

We then decided that there would be a joint and parallel investigation together with the ACA and Bukit Aman.

The modus operandi, in a nutshell, was that cars from Singapore (presumably stolen but usually deregistered) would be driven by syndicate members into Johor Bharu through the Causeway. Yes, the cars came from Singapore but it went through as ‘day visits’ and then left on the roadside where police officers, who were colluding with the syndicate, would confiscate them and take them to the police impound warehouse.

After about a month, these cars would be forfeited and then ‘auctioned off’ by the police. The ‘auction’ was fixed so that a Mr Chen (a second-hand car dealer) would successfully bid for the cars. Once the cars were auctioned off, they were then reregistered with the Johor Bharu Road Transport Department and presented with legitimised logbooks.

Zakaria Chek was involved and so was the then Johor Bharu OCPD, Dato Rahim, who was charged along with a group of around eight police officers who operated from an office in Jalan Meldrum preparing the auction documents.

When we called in Mr Chen for investigation and questioning, he even boasted that he would make sure that we would all get transferred out and that we would feel the wrath of the police bearing against us. He was always seen with Zakaria Chek and Dato Rahim and even had a personal police staff stick that he carried around.

Our team even wanted to conduct a raid on the Johor Bahru central police station to secure evidence but was advised not to do so by HQ, as this would be the first time in history where a police station would be raided and this could cause irreparable reputational damage. However, we gathered such convincing evidence that Dato Rahim and a few other officers were convicted. Zakaria Chek escaped prosecution but was then stuffed in ‘cold storage’.

We seized more than 200 cars.

Although I cannot confirm whether this is the retaliation Mr Chen meant, a few months after the case was exposed, Customs officers were harassed at the Causeway by traffic police officers and summoned for even the most minor of traffic offences. Many officers ended up with dozens of traffic summonses. This, however, was resolved later through mediation.

I hope this will help to set some of the records straight.

Mahkamah bebas peguam Rosli Dahlan

Peguam kanan, Rosli Dahlan bebas tanpa dipanggil membela diri selepas Mahkamah Sesyen Kuala Lumpur memutuskan bahawa pihak pendakwaan daripada Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) gagal membuktikan kes prima facie terhadap kegagalannya mematuhi satu notis untuk mendedahkan segala maklumat mengenai asetnya.

Hakim Abu Bakar Katar memutuskan bahawa notis yang ditandatangani Timbalan Pendakwa Raya Kanan SPRM Anthony Kevin Morais gagal membuktikan peguam itu merupakan seorang daripada sekutu bekas Pengarah Jabatan Siasatan Jenayah Komersil Bukit Aman Datuk Ramli Yusof.

Beliau juga memutuskan pendakwaan gagal untuk membuktikan bahawa Rosli secara sengaja gagal memberi maklum balas terhadap notis yang dikeluarkan Morais.

"Morais juga gagal membuktikan bahawa dia mempunyai asas untuk mengeluarkan notis itu," kata Abu Bakar.

The surat sokongan, the SOP for Barisan Nasional (scanned letter)


Recently, the MACC were frothing at the mouth when they heard that certain DAP leaders from Selangor had issued ‘surat sokongan’ or ‘support letters’ for government jobs and projects. Actually, this is the SOP (standard operating procedure) for Barisan Nasional politicians. The MACC, however, ‘closes both eyes’ to what those from Barisan Nasional do.

Corruption in the UDA's Pudu Jail development project?


The Urban Development Authority (UDA), in joint-venture with Timang Saga Sdn Bhd (who holds 70%), will be developing the site of the old Pudu Jail in Bukit Bintang, Kuala Lumpur. The project is estimated to be worth RM6 billion. Timang Saga is asking those who wish to participate in this development to pay the RM132 million land premium, pay ‘expenses’ of RM5 million, contribute to a RM250 million 'fund', plus offer them shares in the company. That is RM387 million in total, not including the shares in the company. How was this project given to Timang Saga and has the MACC opened a file on the matter or has the file been marked NFA even before it was opened?

Part 3: Proof BN tried to bribe PKR DUN RM5 million to jumpship [BPR report]



The MACC was not set up to combat corruption. Just like the PDRM, SPR, AGC, and others, the MACC has proven to be just another component member of Barisan Nasional. Two years ago, Lim Soo Nee made a report that he was offered a bribe of RM5 million to jump ship. This is the MACC Early Investigation Report on the matter. The case, however, was finally marked NFA.

Part 2: MACC ignored the report but Pak Lah also knows it



Shagul Hamid, the head of BTN, was the adviser to Prime Minister Tun Abdullah Ahmad Badawi. What Shagul Hamid knows, Pak Lah knows. In fact, in most instances, Pak Lah would not act unless on Shagul Hamid’s advice and Shagul Hamid could tell the Prime Minister what he should and should not do. But in this particular case no action was taken -- or maybe no advice was given.

Part 1 : Report on Corruption was ignored by MACC (with letter evidence)



I gave the MACC one week to take action on what Malaysia Today revealed. It appears, however, that the MACC is sidestepping the issue like they did on the PI P. Balasubramaniam matter where they were supposed to take his statement in London and then called it off. Well, I did warn them, so here goes! Starting today, Malaysia Today is going to reveal hundreds of pages of MACC’s investigations into corruption perpetuated by VIPs, which were all eventually swept under the carpet.

Teoh bukan bunuh diri, kata Pornthip

Nota akhir: Keluarga nafi tulisan, tandatangan Teoh

Keluarga mendiang Teoh Beng Hock melahirkan “rasa tidak puas hati, marah dan kecewa” berhubung tindakan Peguam Negara untuk mengemukakan satu nota misteri sebagai bukti ketika inkues bagi menentukan kematian pembantu politik itu hampir kepada penghujungnya.

Dalam satu kenyataan keras yang dikeluarkan di Melaka, keluarga Teoh berkata tindakan Peguam Negara itu amat dicurigai dan menggesa kerajaan mendapatkan pakar tulisan bagi menentukan ketulenan nota berkenaan.

"AG tidak melihat penderitaan kami. Hampir lebih setahun, kami terpaksa berulang-alik dari Melaka ke Shah Alam untuk menghadiri inkues berkenaan,” petik kenyataan itu.

"Jika inkues dimulakan semula, bagaimana kami sebagai satu keluarga mampu melalui penderitaan ini sekali lagi? Adakah AG sengaja cuba menghalang kami daripada menjalani kehidupan seharian?”

Menurut keluarga Teoh, AG memaklumkan bahawa pejabatnya telah memiliki nota berkenaan sejak Oktober tahun lalu tetapi mengapa nota itu tidak dirujuk kepada ahli keluarga Teoh, mahupun peguam mereka.

"Kami menghadiri inkues itu sepanjang tahun. Mengapa mereka tidak memohon bantuan kami? AG hanya mencari alasan (untuk melenggah-lenggah),” kata keluarga itu.

Keluarga Teoh juga mengulangi dakwaan bahawa tulisan dan tandatangan pada nota itu adalah berlainan berbanding yang dimiliki Teoh.

Pada 9 Ogos lalu, inkues yang sedang berlangsung ditangguhkan kepada 18 Ogos, selepas perbincangan semua pihak terbabit di kamar koroner.

Ia dipercayai berhubung spekulasi terdapat nota yang didakwa tinggalan daripada Teoh yang merupakan 'bukti terakhir'.

Teoh Beng Hock : Nota terakhir disembunyi pihak Pendakwa

PSpekulasi berhubung nota yang didakwa tinggalan daripada Teoh Beng Hock yang merupakan 'bukti terakhir' yang muncul awal bulan lalu, kini meninggalkan pelbagai tandatanya.

Pengerusi DAP Selangor Ean Yong Hian Wah yang juga merupakan majikan kepada bekas pembantu politik itu dakwaan nota itu wujud seawal bulan lalu tetapi hanya disahkan oleh pejabat peguam negara semalam menimbulkan banyak persoalan berbanding jawapan.

"Kenapa berita tersebut keluar daripada pihak Umno secara tiba-tiba, (iaitu) melalui blog dan Utusan (Malaysia) dan bukannya daripada pejabat peguam negara atau daripada Suruhanjaya Pencegahan Rasuah Malaysia (SPRM)?" soalnya.

Kandungan dokumen tersebut yang pertama kali dilaporkan oleh Utusan Malaysia susulan daripada satu sidang akhbar oleh sebuah NGO - Jaringan Melayu Malaysia (JMM).

Pada 24 Julai lalu, dilaporkan JMM menuduh dengan kewujudan 'surat penting' tersebut membuktikan bahawa Teoh - yang berumur 30 tahun ditemui terbunuh selepas menjalani soal siasat Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) pada 16 tahun lalu - adalah disebabkan tekanan yang kuat.

Ketika dihubungi, setiausaha agung JMM Tengku Amaluddin Sani berkata kumpulan itu difahamkan mengenai kewujudan dokumen tersebut "tiga atau empat hari" sebelum ia dilapor oleh media.

"Ia adalah satu perkara yang baik, untuk dijadikan sebagai bahan bukti (dalam inkues). Sekiranya dokumen itu benar, maka ia sesuai (dikemukakan) dalam mahkamah," katanya.

Blog pro-Umno memfokuskan banyak perbincangan mengenai dokumen tersebut dan menuduh peguam Tan Hock Chuan - yang mewakili kerajaan persekutuan - 'menyembunyikan bukti berkenaan.

Bekas ketua pemuda PKR yang berpaling tadah, Ezam Mohd Nor pula meminta polis dan SPRM supaya menyiasat nota itu.

“Saya percaya Ezam juga telah membuat laporan polis berhubung perkara itu,” kata Ean Yong yang juga adalah ADUN Seri Kembangan.

Dokumen yang dpercayai 'nota terakhir' itu dijumpai dua bulan selepas kematian Teoh dan sepatutnya dikemukakan di mahkamah koroner semalam, tetapi ia dicabar oleh peguam keluarga Teoh, Gobind Singh Deo.

Menurut Gobind, ia bercanggah dengan peraturan kerana dokumen itu telah disimpan sehingga pada pagi semalam.

Inkues Teoh: Pornthip akhirnya setuju ke M'sia

Pakar patologi Thailand, Dr Pornthip Rojanasunand akhirnya bersetuju datang ke Malaysia bagi memberi keterangan pada inkues bagi menentukan kematian pegawai khas, exco DAP - Teoh Beng Hock.

Adalah difahamkan bahawa Kementerian Keadilan Thailand telah memberikan lampu hijau kepada kerajaan negeri Selangor bagi membolehkan beliau meneruskan kenyataan berhubung penemuannya.

Malaysiakini difahamkan Pornthip akan datang seawal minggu pertama Ogos ini.

Ketika cuba menghubungi pakar patologi Thailand itu, seorang pembantunya mengesahkan Pornthip akan hadir tetapi enggan mengulas lanjut.

Inkues berkenaan dijadual bersambung semula esok dengan keputusan Mahkamah Koroner sama ada Pornthip dibenarkan memberi kenyataan melalui sidang video.

Another false charged courts case involving BPR and PETRONAS

Assamualaikum En. Din Merican,

In brief. I read your recent article with interest.

Earlier I am not politically motivated but just an ordinary citizen who like Anwar Ibrahim and Rosli Dahlan has been charged by the government on a false charge. My mistake was I believed in the government system for justice. It is for abused of power with indirect interest under Section 15A by BPR. Our cases are not only similar, there is a trend.

I was previously a Senior Officer in Petronas of 19 years and was identified to be a black sheep to hike prices for the purchase of Petrol Station Land during 2000. After 6 months I make a U turn and report to my management and in August 2001 I was sacked.

I now alleged the prices was hiked to be dispersed for very important  VIP and interested individuals. I was informed by a Petronas dealer not to worry as BPR is on our side. I presumed they are from political parties.

My grievances on police efficiency to Malaysiankini and Media Keadilan was met with a RM 1 (One) million defamation suit from Petronas in 2005 which never kicked off until today. Petronas has a court injunction against me.

On 4/6/2006 I was arrested by BPR, however my 6 complaints to BPR was not investigated.  The outcome of my last police report is still pending where Petronas individuals have deceived 4 police investigations.

My industrial case is very funny where justice did not prevail. The judges were changed in the 11th hour. In the Industrial Court my subpoenas including my witnesses and documents was strike off by the new judge after being issued by the previous judge. My appeal in the Court was rejected by a new judge change in the 11th hour. My civil suit against Petronas was strike off because of the BPR case.

Clearly the BPR case was used to tarnish my name in the industrial and civil courts. I can prove in Court that the actual criminals are the  BPR  I.O. and mala fide witnesses who are mostly from UMNO and Eonbank. BPR documents submitted have been change and tampered to build a case against me. I was threatened by the BPR PP in front of my solicitor and the Court administrator that if I proceed with the case I will be arrested. She said I should instruct my lawyer to submit an affidavit to throw out the case. I am very sad with the threat as I want the trial to proceed in order to clear my name.

There are now 3 police reports made by me on perjury by 2 of their mala fide witnesses. I am now waiting for the BPR I.O. & Eonbank staffs to be in the witness stand.

In this case my only mistake was giving friendly loans and other assistance to a bogus company under a Vendor Development Programme and trying to prevent a white collar from UMNO individuals. My BPR case will commence on 7-9/7/2010 on Wednesday in Criminal Session Court 7. My third lawyer cannot attend this time as he has to attend a High Court trial which was fixed much later then my trial. If on worse scenario I will present myself. It is so frustrating with the country system.

Tomorrow (yesterday) I will be at Jalan Duta to distribute public documents for the alternative medias as my only hope to expose these irregularities.  I have waited patiently since 2001 and have digested and dwell into the issues.

I did not surface due to the court injunction and now have enough public documents to implicate that BPR can be used as a tools by invincible hands including the former BPR Ketua Pengarah (Zulkifli) who has 3 petrol stations and Timbalan Pengarah BPR Selangor who has one petrol station.  Article from Salahudin Ayub and Gobind Deo in Harakah. So there is a lot truth from the Petronas dealer stated above.

The MACC stripped naked in court



The following is quite a long court transcript on lawyer Rosli Dahlan’s trial. It is most interesting to read what was revealed during the cross-examination of MACC’s Investigating Officer. If this were the manner in which the MACC operates, I would not want to be one of those being investigated by them. Read on and digest what transpired. But I warn you; you may want to migrate after you read this.
