Skandal Pasir: MP Kapar dedah bukti video

Ahli parlimen Kapar S Manikavasagam hari ini mendedahkan saksi bagi menguatkan dakwaannya bahawa syarikat kerajaan Selangor terlibat dalam operasi perlombongan pasir secara haram.

"Hari ini bukan cakap kosong, saya bawa saksi," katanya dalam sidang media di pejabatnya hari ini.

Manikavasagam juga menayangkan rakaman video lokasi yang didakwa berlaku kejadian curi pasir di Selangor bagi serta rekod bertulis berkaitan bagi membuktikan dakwaannya itu.

Sementara itu, saksi tersebut Zahar Rusili memberitahu pemberita beliau mendapati terdapat bukti berlakunya aktiviti perlombongan pasir di Sungai Rasa, Near Rawang, dekat tempat kerjanya.

Zahar berkata, aktiviti penyeludupan pasir haram tersebut dipercayai dilakukan oleh beberapa pihak melibatkan Kuala Semesta Sdn Bhd (KSSB) dan pihak berkuasa berkaitan.

Kontraktor itu juga mendakwa telah mengadu perkara tersebut kepada pelbagai pihak, termasuk KSSB, polis, pejabat Menteri Besar Abdul Khalid Ibrahim dan Suruhanjaya Pencegaran Rasuah Malaysia (SPRM) tetapi tiada sebarang tindakan diambil.

Bagaimanapun, menurut Manikavasagam, Jawatankuasa Pilihan Khas Mengenai Keupayaan, Kebertanggungjawaban dan Ketelusan (Selcat) yang akan memulakan pendengaran awam berhubung kes itu esok telah menolak Zahar selaku saksi.

Perbicaraan kes liwat Ketua Pembangkang, Datuk Seri Anwar Ibrahim ditangguhkan sehingga petang esok bagi membolehkan semua pihak melawat tempat kejadian semula.


Pada permulaan prosiding peguam mewakili Anwar, Karpal Singh membuat permohonan untuk melawat semula ke tempat kejadian dan mahkamah membenarkan permohonan itu.

Pada perbicaraan sebelah pagi, pengadu yang juga saksi utama, Mohd Saiful Bukhari Azlan berkata beberapa individu yang ditemuinya untuk membuat aduan mengenai kejadian liwat itu tidak menggalakkannya membuat laporan polis kerana mereka bimbangkan masa depannya yang masih muda.

Antara mereka yang ditemuinya itu adalah timbalan perdana menteri pada ketika itu Datuk Seri Najib Razak, bekas setiausaha politik Anwar, Mohamad Ezam Mohd Noor, pegawai kanan polis Datuk Mohd Rodwan Yusof (yang kini Ketua Polis Melaka), bekas ratu trek negara Datuk Mumtaz Jaafar, rakannya Rahimi Osman, bapa saudaranya yang dikenali sebagai Tuah dan seorang guru agama yang dipanggil Atuk.

al: Ada Timbalan Perdana Menteri beri apa-apa nasihat?

Saiful: Pada mulanya beliau terkejut, ragu-ragu. Tapi lepas cerita dengan terperinci, beliau kata beliau tidak boleh buat apa-apa kerana ini adalah masalah peribadi Anwar dan membabitkan masa depan saya.

Karpal: Adakah pada bila-bila masa anda membuat laporan polis mengenai aduan yang dibuat kepada Timbalan Perdana Menteri, dan orang lain tadi?

Saiful: Sebelum 26 Jun 2008 (dakwaan berlaku liwat), saya tidak membuat laporan polis.

Karpal: Tidak ada siapa yang beri nasihat kepada anda supaya membuat laporan polis?

Saiful
: Tidak ada. Mereka bimbang tentang masa depan saya.

Kepada soalan Karpal sama ada beliau mengetahui mengikut Seksyen 13 Kanun Prosedur Jenayah, adalah menjadi satu kewajipan seseorang itu membuat laporan polis sekiranya mengetahui mengenai kejadian liwat, Saiful berkata beliau tidak tahu mengenai perkara itu.

: Jika TPM atau yang lain tidak membuat laporan polis, mereka telah melakukan satu kesalahan di bawah Seksyen 202 Kanun Keseksaan dan boleh dipenjarakan. Tahu atau tidak?

Saiful
: Saya tidak tahu.

Karpal
: Tidak mengapa, saya akan beritahu awak sekarang. Apa yang anda beritahu TPM adalah perkara serius iaitu anda diliwat tanpa kerelaaan.

Sebelum Karpal menghabiskan soalannya Peguam Cara Negara II, Datuk Mohamed Yusof Zainal Abiden, yang mengetuai barisan pendakwaan, membantah kerana itu bukannya soalan tetapi komen dan ia dipersetujui Hakim Datuk Mohamad Zabidin Mohd Diah yang mendengar perbicaraan kes itu.

"Saya mahu dengar soal bukannya komen. Teruskan dengan solan," kata Mohamad Zabidin kepada Karpal.

Mengenai soalan Karpal bahawa beliau mempunyai banyak peluang untuk melarikan diri kepada pengawal keselamatan kondominium atau menjerit semasa kejadian liwat dan mengapa tidak menggunakan peluang itu, Saiful menjawab bahawa beliau tidak menggunakan peluang itu.Kepada soalan lain mengenai keluarganya, Saiful berkata ibubapanya telah bercerai ketika beliau berumur tujuh tahun dan beliau tinggal dengan bapanya dan adiknya, Saidati.

Menjawab soalan Karpal mengenai sama ada adiknya telah berkahwin, Saiful berkata pada tahun lalu adiknya telah dibawa lari ke Thailand dan beliau tidak pasti sama ada adiknya telah berkahwin atau tidak.

Karpal kemudiannya memohon supaya pemeriksaan balasnya terhadap Saiful ditangguhkan dan pihaknya akan memanggilnya semula.


Menjawab soalan, Mohamed Yusof dalam pemeriksaan semula, Saiful berkata beliau tidak pernah memberitahu Dr Osman Abdul Hamid dari Pusrawi, yang merawatnya, bahawa ada terdapat kemasukan objek plastik di bahagian duburnya.



Anwar didakwa meliwat Mohd Saiful di Unit 11-5-1 Kondominium Desa Damansara, Jalan Setiakasih, Bukit Damansara, di sini antara 3.01 petang dan 4.30 petang pada 26 Jun 2008.

Pertuduhan itu membawa hukuman penjara sehingga 20 tahun dan sebatan jika disabit kesalahan.

Rakyat M'sia antara diserang kapal perang Israel

Rakyat Malaysia yang menaiki sebuah daripada enam flotila bantuan kemanusiaan kepada penduduk Gaza diserang kapal perang Israel mengakibatkan 16 orang terbunuh manakala puluhan lagi cedera.

Menurut The Star, rakyat Malaysia itu adalah krew televisyen dari Astro yang menaiki kapal dari Turki.

Sementara itu menurut AFP yang memetik laporan televisyen yang dimiliki Hamas, anggota komando Israel menyerbu sekurang-kurangnya sebuah kapal yang didakwa dipenuhi aktivis pro-Palestin yang berjuang untuk Gaza.

Televisyen Al-Aqsa Gaza, menunjukkan imej video komando Israel yang berpakaian serba hitam turun daripada helikopter dan bertempur dengan kumpulan aktivis, di mana beberapa yang cedera kelihatan terbaring di atas dek kapal itu.

Rangkaian televisyen berkenaan berkata, dua aktivis terbunuh manakala 50 yang lain cedera.
Tentera Israel enggan mengulas laporan itu dan penganjur konvoi bantuan berkata, mereka terputus hubungan dengan bot berkenaan.

Kapal itu membawa lebih 700 penumpang, iaitu peringkat terakhir misi berprofil tinggi bagi menghantar lebih 10,000 tan bekalan bangunan dan yang lain ke Gaza, di mana keadaan di situ lumpuh akibat sekatan Israel sejak 2007.

Rasuah Pilihanraya di Sibu RM147,600 untuk 12 rumah panjang

Seorang pemerhati bebas mendedahkan kesalahan yang dilakukan oleh Setiausaha Agung DAP Lim Guan Eng dalam lawatannya di rumah panjang semasa pilihan raya kecil Sibu awal bulan ini.

Lim (kanan) yang juga Ketua Menteri Pulau Pinang, mendakwa telah bertanya kepada penduduk rumah tersebut sama ada Ketua Menteri Sarawak Tan Sri Abdul Taib Mahmud memberikan RM100 sebagai sebahagian daripada program untuk warga tua (seperti yang dilakukan di Pulau Pinang).

"Apa fikir apa respon mereka?" soal Ong Boon Keong - yang mewakili Pemerhati Piihan Raya Malaysia - pada forum pasca pilihan raya Sibu di Pulau Pinang.

"Semua orang senyap dan tidak berani bersuara, yang mana pada setiap pilihan raya, mereka menerima RM600 bagi setiap rumah!

"Jika petugas DAP mengetahui perkara ini, mereka tidak akan bertanyakan sama ada setiap rumah menerima RM100, mereka tahu nilai ini tidak munasabah."

Pada hari-hari terakhir kempen Abdul Taib mengumumkan geran berjumlah RM147, 600 untuk 12 rumah panjang di Tanjong Penasu - setiap satu daripada keseluruhan 246 pintu menerima RM600.

Sementera itu, wakil PAS, Zamry Ibrahim yang juga seorang ahli majlis di Kedah berkata, kehadiran Pakatan Rakyat di Sibu amat kurang terutamanya di kawasan majoriti Melayu/Islam.

"Kebanyakkan kaum Melayu/Melanau dan Dayak telah menyokong pembangkang, bahkan sebelum 8 Mac (pilihanraya umum pada tahun 2008), tetapi secara tidak terancang. Kumpulan ini akan mengundi sesiapa sahaja asalkan ianya bukan daripada BN," katanya.

"Ramai yang mahu berubah tetapi takut untuk menunjukkannya kerana BN mengawal mereka melalui ketua rumah panjang atau dengan cara 'menyuap' mereka."

Beliau merujuk kepada elaun RM450 yang telah dibayar oleh pihak kerajaan kepada ketua rumah.

Mahfuz: BN cuba rasuah Samy Vellu

Naib Presiden PAS, Datuk Mahfuz Omar menuntut Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) menjalankan siasatan terperinci bagi menyelamatkan khazanah kekayaan negara daripada disalah-gunakan.

Tuntutannya itu berikutan pendedahan oleh S Vell Paari yang mendakwa seorang pegawai dari jabatan perdana menteri telah datang membuat tawaran berkenaan kepada bapanya, yang juga Presiden MIC, Datuk Seri S Samy Vellu.

“Pegawai Khas PM telah datang membawa tawaran dari PM menawarkan gelaran Tun dan jawatan Duta bagi tujuan kompromi isu calon BN untuk pilihanraya kecil Hulu Selangor.

“Pendedahan ini suatu yang serius yang menunjuk ada unsur dan amalan rasuah dalam pemilihan calon BN dari MIC dalam PRK Hulu Selangor,” katanya pada kenyataan medianya hari ini.

Menurut Mahfuz, dakwaan Vell Paari menunjukkan amalan tawaran yang berunsur rasuah itu bukan saja berlaku dalam pemilihan calon BN di Hulu Selangor, tetapi juga berlaku dalam banyak hal lain untuk memastikan apa saja keputusan yang dibuat oleh perdana menteri yang juga pengurusi BN diterima oleh semua peringkat dalam BN.

Tambah ahli parlimen Pokok Sena itu, amalan berkenaan bertujuan menutup mulut pemimpin BN agar tidak membuat kacau sehingga boleh menjejaskan kepentingan politik mereka.

Perbuatan itu, kata Mahfuz adalah “satu bentuk amalan buruk dalam penyalahgunaan kuasa yang boleh mengakibatkan kehilangan khazanah negara yang diagihkan kepada pemimpin Umno BN setiap kali berlaku krisis di kalangan dalaman mereka”.

Harga petrol mungkin dinaikkan 15 sen tahun ini

Harga petrol mungkin dinaikkan buat permulaannya 15 sen bagi setiap liter daripada harga sekarang pada tahun ini.

Harg
a petrol RON 95 ketika ini dijual pada harga 1.80 ringgit bagi setiap liter.

Harga baru itu berikutan cadangan sebuah badan yang bertanggungjawab menasihatkan kerajaan berhubung cara-cara mengurangkan subsidi.

Cadangan itu dibuat pada pembentangan awam dalam usaha awal kerajaan untuk mengurang defisit dalam belanjawan negara yang kini pada tahap tertinggi bagi tempoh 20 tahun.

Mengikut cadangan yang dikemukakan kepada lembaga penasihat itu, harga petrol akan dinaikkan tahun ini dan diikuti dengan dua lagi kenaikkan pada kadar 20 sen setiap liter setiap kenaikkan pada 2011 dan dua lagi kenaikan, juga pada kadar 20 sen bagi setiap kenaikkan pada 2012.

Pada
sepanjang 2013-2015, kenaikan harga minyak akan bergerak perlahan dan pada penghujung 2015, harga RON95 dijangka berada pada 2.60 ringgit bagi setiap liter.

Bagaimanapun rancangan kenaikkan yang dicadangkan itu masih belum diluluskan oleh kerajaan.

Ramalan itu adalah berdasarkan harga minyak mentah pada harga $73.06 bagi setiap tong pada 2011 dan $79.41-$94.52 bagi 2013-2015.
Cadangan pengurangan subsidi

Kerajaan akan menaikkan harga petrol, gas dan tol lebuhraya di bawah rancangan pengurangan subsidi selama lima tahun yang dibuat oleh PEMANDU, sebuah badan yang menasihatkan kerajan mengenai cara-cara mengurangkan subsidi.

Bagaiamanapun tiada keputusan yang dibuat dan kerajaan dijangka tidak akan membuat keputusan dalam jangka terdekat ini.

Pengurangan dan pemotongan subsidi itu membabitkan 12 perkara:

ga petrol prices dinaikan 15 sen pada Jun-Dis 2010, diikuti kenaikan 10 sen setiap enam bulan antara Jan 2011-Dis 2012 dan jumlah kenaikkan yang kecil bagi tahun-tahun berikutnya.

Gas
Harga gas dinaikkan pada kadar tetap RM3/MMBTU bagi setiap enam bulan daripada harga sekarang bagi sektor tenaga dan sektor bukan tenaga.

Kenaikkan harga gas pada RM3/MMBTU setiap enam bulan serentak dengan kenaikkan tarif elektrik 1.6 sen/kWh bagi setiap enam bulan.

Perumahan kos rendah juga disalahgunakan di Puchong

The Sun sejak 3 hari lepas telah memaparkan berita muka depan berkaitan pegawai tertinggi dan kakitangan MBPJ memiliki rumah pangsa kos rendah walaupun mereka tidak layak. pelbagai cerita telah keluar dan diselongkar. MB Selangor telah mencadangkan agar rumah-rumah ini ditarik balik dan ada pegawai MBPJ yang secara sukarela bersedia untuk menyerahkan nya semula.

Saya pernah bekerja selama lima tahun dengan sebuah syarikat pemaju perumah di Puchong dan saya ingin berkongsi kisah dalaman kes ini. Untuk makluman saya meninggalkan syarikat tersebut pada tahun 2008.

Untuk makluman semua, majoriti kakitangan syarikat H memilik rumah kos rendah walaupun ada yang tidak layak. Begitu juga dengan Arikitek dan kontraktor-kontraktor yang bekerja dengan syarikat H. Bagaiamana ini boleh berlaku?

Untuk mendapat kebenaran membina taman perumahan yang mengandungi rumah-rumah teres contohnya, pemaju dikenakan syarat bahawa mereka perlu membina 1 unit rumah kos rendah untuk layak membina 3 rumah teres. Ini bertujuan untuk memastikan rumah-rumah kos rendah terus dibangunkan kerana ianya tidak menguntungkan. Jadi jika pemaju ingin menbina 3000 unit rumah teres maka ia perlu terlebih dahulu membina 1000 unit rumah kos rendah.

Permohonan untuk membeli rumah kos rendah perlu diluluskan oleh Pejabat SUK Shah Alam. Maka apa yang dilakukan di Syarikat H tempat saya bekerja adalah semua kaum kerabat pemaju akan menghantar borang permohonan melalui syarikat pemaju. Borang ini akan disertakan dengan salinan IC dan bil utiliti sebagai bukti pemohon tinggal di kawasan berkenaan. Jadi, sesiapa yang tinggal diluar kawasan tersebut akan meminjam bil utiliti teman-teman yang tinggal di kawasan berkenaan.

Borang tersebut akan dicop dengan cop syarikat pemaju dan dihantar sendiri ke Pejabat SUK Shah Alam oleh Pengurus Pemasaran Syarikat H. Ianya gerenti lulus. Saya sendiri pernah menerima surat daripada SUK sekitar tahun 2005 menyatakan saya layak mendapat 1 unit rumah kos rendah. Surat tersebut perlu ditunjukkan kepada pemaju untuk melayakkan saya untuk membeli rumah tersebut. Saya bersyukur saya tidak membelinya ketika itu.

Untuk makluman semua, semasa rumah kos rendah dibuka untuk jualan, mereka yang layak akan dipanggil untuk membuat cabutan unit. Maksudnya cabutan dibuat oleh pembeli untuk mengetahui mereka mendapat unit ditingkat mana. Sudah tentu tingkat bawah menjadi rebutan.

Rumah kos rendah di Puchong adalah 4 tingkat. Tahukah anda cabutan unit rumah tersebut dilakukan secara tidak jujur oleh pemaju. Para pembeli akan datang awal untuk cabutan dengan harapan boleh mendapat unit ditingkat bawah sebenarnya mereka tertipu kerana nombor unit rumah yang ada di dalam kotak cabutan pusingan pertama hanyalah unit-unit ditingkat 3 dan 4 sahaja. Unit ditingkat bawah akan dimiliki oleh staf-staf pemaju dan kaum kerabat mereka. Saya sendiri berpeluang 'memilih' sebuah unit tepi (corner unit) di tingkat bawah. Itulah keistimewaan menjadi staf pemaju H.

Saya cuma ingin memaklumkan bahawa penipuan rumah kos rendah ini bukan sahaja berlaku di MBPJ, malahan di MP Subang Jaya dan juga lain-lain kawasan di seluruh negara.

Kenapa ia berlaku? Mudah sahaja.. kerana wang. Ansuran bulanan bank bagi sebuah unit rumah kos rendah berharga RM42000 adalah sekitar Rm250- Rm300 sedangkan unit tingkat bawah rumah kos rendah boleh disewakan pada kadar minima RM450 dan ke atas. Mudahnya untuk atas angin dengan mengambil hak orang lain.

Rumah tingkat bawah yang dibeli pada harga RM42000 juga mudah dijual semula pada harga melebihi RM65000. Terdapat syarat-syarat tertentu untuk menjual kerana ianya dibawah kawalan Pejabat SUK. Apa yang biasa dilakukan adalah pembeli akan membayar cash dan agreement berasingan dibuat sementara menunggu tempoh yang sesuai untuk melakukan penjualan secara sah. Majoriti pembelinya adalah mereka yang menyewa di kawasan tersebut juga.

Mari kita fikirkan. Orang yang layak tetapi tidak dapat membeli rumah tersebut terpaksa menyewa daripada mereka yang tidak layak tetapi dapat membeli rumah tersebut. Adilkah dunia ini? Jika tiadanya penyelewengan dan semua kakitangan kerajaan bertugas dengan amanah dan jujur semua ini tidak akan berlaku!

Maka bangunlah dan berubah. Kita tidak boleh lagi membiarkan kekejaman berlaku di sekeliling kita tanpa batasan. Undilah untuk perubahan!

PETALING JAYA (May 25, 2010): A new twist to the saga of low-cost units being sold to ineligible buyers has emerged.

The so-called circular to Petaling Jaya City Council (MBPJ) staff informing them of the availability of low-cost units irrespective of eligibility was issued by the planning department, and not the president or mayor’s office, it is learnt.

It has also emerged that such a circular or policy was never presented for endorsement by the full board of the council as required by law and convention.

While letters from Planning Director Sharipah Marhaini Syed Ali to deputy mayor Puasa Md. Taib, and Puasa’s own explanation to the State Special Committee on Local Councils indicated that the purchases of low-cost flats were sanctioned by the State Government and then council president Datuk Emran Kadir, to date there is no evidence to that effect.

“What has been determined is that the policy on allocation of houses to council staff, including department heads and directors, came from the planning department,” said a source.

In a letter to Puasa on Feb 4 this year, Sharipah said the council president had in 2001 asked developers who were not involved in the squatter relocation exercise to allocate units for council staff.

“Details of the availability of the houses were openly disseminated to staff via e-mail,” Sharipah wrote.

She also said the Sri Jati flats where she owns a unit was not meant for squatter relocation, although a year earlier, in a note to the State Housing and Property Board, she had indicated that squatters from Kampung Tropicana and Kampung Lembah would be moved there.

Puasa, in his March 8, 2010 memo to the State Government, said the then executive councillor for housing (Datuk Mohd Mokhtar Ahmad Dahlan) and then council president (Emran) in 2001 had decreed that low-cost houses could be opened to council staff as an incentive.

Both Mohd Mokhtar and Emran have said they could not remember issuing such directives, while the present State administration have said that bending the rules on low-cost home ownership was never sanctioned by the Executive Council.

Former MBPJ councillor V. Subramanian said that the allocation of low cost units to staff was never endorsed by the full board.

“We never approved it at council level. You can check the full board minutes,” said Subramaniam, who served between 2000 and 2008.

He said the decision to allocate 10% of the Sri Jati flats in Ara Damansara to council staff never landed on the councillors’ desks.
However, he pointed the finger back at Emran, saying the policy allowing 500 staff to buy low-cost homes was introduced during Emran’s tenure when local councils took over the implementation of squatter relocation programmes from the state.

He added that the State Executive council never endorsed this policy.

“But at that time, the way things were done, the word of one individual, be it the mentri besar or exco for housing became law,” said Subramaniam.

He said he had on many occasions brought up the matter at full board meetings.

"Check the meeting minutes, they should have recorded my objections to the policy.
"Many council staff including heads departments who do not deserve the units were given homes," he said, adding that he had told the council that low-cost units should only be allocated to MBPJ workers who fall within the RM2,500 income bracket.

He said all councillors agreed that all low-cost units should be for the lower income group.

“We agreed that for large families, they could buy two low-cost units at RM35,000 for the first unit and RM42,000 for the second one.

“But in my time, many squatters were not given homes and had to rent from those who are not eligible to buy low-cost houses,” he claimed.

On allegations of political quota for low-cost units, Subramaniam said there was no proof of this but agreed it was rampant.
He said when he was the MIC Petaling Jaya Barat division chief, he had supported the applications of low-cost units to party members including branch chairmen.

“But they were all deserving cases comprising low income earners,” he added.

Subramaniam said he had previously threatened to lodge reports with the police and Malaysian Anti Corruption Commission (MACC) over the abuse of low-cost units if MBPJ does not ensure only deserving cases are allotted homes.
“But they could not be bothered,” he said, adding that he has contacted MACC investigations director Mustafar Ali to extend his co-operation.

Peguam yang mewakili penyiasat persendirian P Balasubramaniam telah menguruskan perjalanan bagi Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) datang untuk menemubual pelanggannya itu di London Julai ini.
Dalam satu emel yang dihantar kepada seorang pegawai SPRM hari ini, peguam Americk Singh Sidhu meminta pegawai penyiasat kes tersebut supaya memanjangkan tawaran tersebut kepada pegawai atasannya - pengarah siasatan, Datuk Mustafar Ali.

"Kami telah menguruskan persiapan untuk mereka hadir di London dari 3 hingga 12 Julai untuk tujuan menemubual dan merakamkan kenyataan Balasubramaniam.

"Semua penerbangan dan penginapan (untuk SPRM) telah diuruskan," kata Americk dalam emelnya itu yang salinannya diperolehi Malaysiakini.

Balasubramaniam juga diwakili oleh peguam Manjeet Singh Dhillon.
Americk berkata, daripada mengadakan temubual itu di Pesuruhjaya Tinggi Malaysia di London - seperti yang dicadangkan oleh Mustafar dalam satu wawancara dengan akhbar New Straits Times semalam - satu bilik mesyuarat akan ditempah di London.

"Pelanggan saya tidak bersetuju temubual itu dijalankan di Pesuruhjaya Tinggi Malaysia di London, dan kami juga tidak merasakan perlunya ia diadakan di situ," tambahnya.

SPRM, ketika dihubungi, tidak berhasrat memberi sebarang komen.

(The Star) - Private investigator P. Balasubramaniam’s lawyer has rubbished a claim by the Malaysian Anti-Corruption Commission (MACC) investigations director that it was his client who had delayed recording his statement.


“This is absolute rubbish! They were never ready and this chap Mustafar (Ali) is pulling wool over everyone’s eyes.


“Bala has always been ready and available,” said his counsel Manjeet Singh Dhillon in an email to The Star from London yesterday.


Manjeet was responding to a report in an English daily yesterday that the MACC was recording his client’s statement in July at Balasubramaniam’s request.


“We were ready a long time ago but he said he would only be ready in July,” Mustafar had said.
Mustafar’s statement came a day after Manjeet was reported in The Star as saying he was going to London to look for a neutral venue for the MACC to record Balasubramaniam’s statement relating to the murder of Mongolian Altantuya Shaariibuu.


On April 19, MACC Deputy Commissioner Datuk Mohd Shukri Abdull said they would meet Ba­­lasubramaniam “anywhere he felt appropriate” and not only at Malaysian embassies abroad, but yesterday Mustafar was quoted as saying they would decide on the venue for the interview in London.


“(We need to identify) where to record his statement. We cannot simply do as he wishes.”
Manjeet said it was ridiculous for Mustafar to suggest replacing the Malaysian High Commission in Singapore with the Malaysian High Commission in London.


A proposed interview at the High Commission in the island republic was scrapped because the MACC said it would be classified under the Official Secrets Act, and conducted without video-recording or lawyers.


Manjeet said Mustafar should stop using the media to project an image inconsistent with the facts.
“If the MACC is serious and sincere about doing the job, they should get on with things and respond to my letter of Jan 22,” he said.

Seeking a venue to quiz Bala

The Malaysian Anti-Corruption Commission (MACC) will decide on a suitable place in London to record private investigator P. Balasubramaniam's statement relating to the murder of Mongolian national Altantuya Shaariibuu.
MACC investigation director Mustafar Ali said because Balasubramaniam was abroad, it needed a proper place to carry out the investigation.

"(We need to identify) where to record his statement. Is it at the Malaysian high commission? We cannot simply do as he wishes," he said yesterday.
An online newsportal recently reported that Balasubramaniam was ready to provide his statement after "disappearing" for two years.
On Friday, the MACC released a statement saying that it was ready to meet Balasubramaniam in London in July to record his statement.

Asked why it had to wait until July, Mustafar said it was at Balasubramaniam's request.
"We were ready a long time ago but he said he would only be ready in July. We are accommodating his request."

On July 3, 2008, Balasubramaniam made a statutory declaration related to the murder of Altantuya but withdrew it the next day through a second declaration. He disappeared abroad soon after with his family.

On another matter, Mustafar said the MACC had not opened an investigation paper into Sime Darby as it was waiting for the company's internal inquiry to be completed.
"We also need to analyse various information pertaining to the matter but so far, no statements have been recorded."

However, he said the commission would call up anyone, including company chairman Tun Musa Hitam, to assist in investigations if there was any element of corruption.

Sime Darby recently confirmed the market's worst fears when it announced that it would have to book in massive losses over projects in the Middle East as well as the Bakun hydroelectric dam project in Sarawak.

It is expected to book in close to RM1 billion losses in its third quarter results, which are expected to be released on Thursday.

(The Malay Mail) - The Malaysian police has been in talks with UK's Scotland Yard for assistance in their bid to nab controversial blogger Raja Petra Kamarudin (RPK) during his trip to London soon.

"Malaysian police have done whatever they can in their power and the matter is now being dealt with by the Attorney-General Chambers," said Deputy Inspector General of Police Tan Sri Ismail Omar at the Bukit Aman staff monthly gathering this morning.

"Raja Petra is alive and free. We have been hunting him for a while now and this is a good opportunity for us to capture him," said Ismail.

"We are in touch with Scotland Yard and they know he is highly wanted in our list. A lot of effort have been put in by all parties concerned. Hopefully, if everything goes to plan, we will have him nabbed soon," said Ismail.

Raja Petra is scheduled to give a discourse in London this Saturday to give an account of his personal experience in campaigning for greater transparency and accountability in Malaysian politics. (More details of the event here).

He will be hosted by the Solicitors International Human Rights Group.

In a flyer promoting Raja Petra's talk, he was described as the only blogger who has been so systematically targeted for speaking out and fighting for greater democratic space, justice and a more inclusive society in Malaysia.

It also said that for his activism, Raja Petra had been detained twice under the Internal Security Act.
Following the talk, Raja Petra will be signing copies of his book The Silent Roar, A decade of change.

Scotland Yard says RPK not wanted



A visit to the New Scotland Yard office today revealed that there is no extradition request from the Malaysian government, nor is there any warrant of arrest issued against Raja Petra Kamarudin, as what The Malay Mail reported here: http://www.malaysia-today.net/index.php?option=com_content&view=article&id=31962:scotland-yard-to-help-nab-rpk&catid=19:newscommentaries&Itemid=100131)
A further check with Interpol in Paris revealed the same thing.

In fact, said Scotland Yard, there is no extradition treaty between the Malaysian and British governments so it would be extremely difficult for Malaysia to request for anyone to be extradited from the UK.

DS Najib promises RM5Million for Sibu if BN wins. Is this RM5Million his own money or RAKYAT's money? How can a PM uses people's money for his own benefit? If BN wants to continue to do that, then make the Income Tax flexible because I don't want the tax money that I pay for the growth of the country and people to be misused by corrupt leaders!


If money cannot get votes, what do you have left? 

Mr Prime Minister you said it loud and clear to the people. You vote my candidate in and I will help you! A very basic tit for tat situation that leaves no doubt to the people of Sibu that they need to teach you a lesson in eating humble pie. I watched the spectacle that Najib made of himself just the other day in campaigning for the Sibu by-election. Wiping spit and sweat off his face as he horse-traded with the people of Sibu. “If Robert Lau becomes the MP on Sunday, on Monday I will ask the cheque to be prepared. Do we have a deal or not? We do! You want the RM5 million, I want Robert Lau to win,”

You help me and I will help you! You scratch my back and I will scratch yours! The audacity of our Prime Minister to horse-trade with the people he has sworn to serve! Why? Has he taken it upon himself to “turun padang” - down to the level of those corrupt government officers and PDRM who is so fond of reminding us that to help us, we must first help them? It brings back unpleasant memories of my time in the immigration department at which I have spent a good many hours trying, without any success, to get PR status for my family.

I remember that one day when the Napoleonic immigration officer across the counter arrogantly told me that my wife is to be “denda” the sum of $1000 a day for each of the three days that she had overstayed. It took a lot of control for me to not spit in his face. With all the self-control I could muster, I turned and walked away. I then went to get a “support” letter from one UMNO big wig which “selesai” the matter without any “denda” being imposed.

As I watched our Prime Minister sweating away on center stage, it brings back to me those unpleasant encounters I have had in the past when corrupt mata-matas happen to find me making minor traffic infringements while they are doing their “cari makan” rounds. Their routine is precise. “Lesen Encik … Encik dari mana, … ke mana … kerja apa” … out with his “summon book” and the start of his scribbling to nudge us closer to the “selesai” talk. Now we start to do the asking … "Tolong Datok … or as the Chinese say “Latok”… And he comes back with the “Macam mana saya nak tolong ni?” Sound familiar?

With the policeman, the deal is done there and then. He gets his money and we are off. With Najib, he does not know if his “offer” is good enough for the people to accept. Whether they want more or whether they are prepared to get a summon or even go to jail (as the policeman had threatened to do if no “selesai” takes place) … but Najib is game. He makes the RM$5 million offer and promises to deliver if the other party reciprocates by giving the Barisan Nasional candidate their votes. After the offer, Najib must have felt it was a done deal after all it was a promise that would cost a few million ringgit to deliver and all they had to do was “pangkah” Najib's man. But, as in all deals with Barisan Nasional, it is always a one way trade. Damn if you do and damn if you don’t. But now we know that the people of Sibu could not be bothered if they are damned even as they said “NO”.

With Najib, as I watched him wipe away the spit and the sweat of his pudgy face, my initial compulsion was to turn away from the spectacle of our Prime Minister telling the Rakyat that they must help him first before he can help them. But, like watching an accident as you drive past, even as your head wants to turn away from the blood and the gore, you will find yourself continuing to look and watch this sad man trying to win over voters the only way he knows how – by buying their votes! But as we now know, to no avail because when I awoke on Monday morning, DAP had won.

What now, Mr. Prime Minister? Because if money cannot buy votes then UMNO is in trouble! If UMNO is in trouble then you too are in trouble and by elementary deduction, so would Rosmah, Muhyuddin, Rais, MCA, MIC … in fact the whole gang would be in strife. The beginning of the end, perhaps? The harbinger of things to come in the not-too-distant future?

Mr Prime Mister Sir, I would suggest that you refrain from “punishing” the people of Sibu for not voting your candidate in lest they punish you again in the coming general elections next year. Lashing out at the voters who deserted you will bring more harm to UMNO than to the people who did not vote you in. Making an example of them will only lead to more votes going to PKR. In retrospect, that might not be such a bad thing after all ….

Mr Prime Minister you said it loud and clear to the people. You vote my candidate in and I will help you! That the people of Sibu was not bought over by his usual attempt at “BUY election” must be worrying for Najib. It was not Muhyiddin that was making the offer. It was the head honcho himself. I only have this to say to Najib - be afraid, be very afraid. If money cannot get votes, what do you have left?

As Billy Joel said “Honesty is such a lonely word. Everyone is so untrue. Honesty is hardly ever heard. And mostly what I need from you”.

It is back to the drawing board for the UMNO guys.

Khalid : Media putar belit kenyataan saya

SHAH ALAM: Menteri Besar Selangor Tan Sri Abdul Khalid Ibrahim menegaskan bahawa kenyataan beliau berhubung kejadian yang menimpa Ahli Parlimen Kapar S.Manikavasagam di putar belit oleh media arus perdana.

Menurutnya, media sengaja memutar belitkan cerita menjadi sensasi supaya berlaku perselisihan faham di antara beliau dengan Manikavasagam.

"Saya tidak bermaksud untuk mengeluar kenyataan sedemikian kepada Ahli Parlimen Kapar dan saya cuma memberi nasihat sahaja," kata beliau kepada sidang media selepas menemui delegasi pelabur dari Indonesia di Shah Alam hari ini.

"Maksud sebenar saya, Manikavasagam perlu bersedia menghadapi sebarang kejadian selepas beliau mendedahkan penyelewengan projek pasir dalam syarikat Semesta Sdn Bhd, kerana pihak yang terlibat tidak akan berpuas hati terhadap pendedahan itu.

Khalid berkata, beliau turut mengutuk tindakan kejam mereka yang tidak bertanggungjawab terhadap Manikavasagam.

"Saya sendiri merasakan tindakan merosakkan harta benda milik orang lain adalah kejam dan saya harap polis dapat melakukan siasatan untuk menyelesaikan masalah ini.

Tambah beliau, pendedahan yang dilakukan oleh Ahli Parlimen Kapar disokong sepenuhnya oleh kerajaan negeri supaya membantu memperingatkan orang lain agar tidak melibatkan diri dalam rasuah.

"Saya harap Manikavasagam tidak termakan dengan niat jahat media arus perdana yang mencari jalan untuk melagakan saya dan beliau," katanya.

"Saya harap Khir Toyo tidak campur tangan"

Sementara itu, Khalid juga menyelar tindakan bekas Menteri Besar Selangor Datuk Seri Dr Khir Toyo yang menuduh beliau terlibat dalam penyelewengan pasir Syarikat Semesta Sdn Bhd.

Beliau berkata, Khir Toyo sengaja mengambil kesempatan dalam usaha untuk menjatuhkan kerajaan di bawah pimpinan beliau dan juga mencari populariti murahan untuk menonjolkan diri.

"Kenyataan Khir Toyo adalah tidak wajar dan merupakan satu penipuan untuk merosakkan imej saya," tegas beliau.

"Saya harap beliau tidak perlu campur tangan kerana tidak berkaitan dan beliau sepatutnya sedar terhadap banyak penyelewengan yang beliau lakukan di Selangor ini," katanya.

Bercakap mengenai pelaburan Indonesia di Selangor, Khalid berkata, kerajaan negeri memperkenalkan kepada para pelabur Indonesia dengan satu kawasan untuk dijadikan taman perindustrian halal dan juga kawasan industri perkilangan iaitu di Selangor Science Park 2 di Sepang.

Beliau berkata, para pelabur Indonesia menyatakan kawasan tersebut mempunyai potensi yang besar untuk diusahakan bagi mecapai pulangan yang lumayan.

" Saya berharap para pelabur yang hadir akan bekerjasama lebih erat bersama kerajaan negeri Selangor demi mencapai kemajuan bersama," katanya.

Tubuh Inkuiri Awam Siasat Bencana Sime Darby

PETALING JAYA: Kerajaan Umno-Barisan Nasional (BN) sekali lagi mengulangi kesilapan masa lalu apabila menyerahkan projek empangan hidro elektrik Bakun, Sarawak kepada Kumpulan Sime Darby hingga menyebabkan konglomerat itu terpaksa menanggung kos lewat siap projek (cost over runs) melebihi RM1 bilion. 

"Kesilapan kerajaan ialah kerana menganugerahkan projek Bakun di mana Sime Darby tidak mempunyai kepakaran," kata Ahli Parlimen Klang Charles Santiago kepada Free Malaysia Today, hari ini.

Beliau merujuk kepada kesilapan masa silam di mana Sime Darby terpaksa menanggung kerugian kerana melibatkan diri dalam perbankan walaupun mereka tidak ada kemahiran dan kepakaran dalam sektor perbankan.

Pada awal tahun 1998, anak syarikat Sime Darby, Sime Bank Berhad (dulunya United Malayan Banking Corp Bhd) mencatat kerugian sebanyak RM1.57 bilion dengan peruntukan pinjaman tidak berbayar berjumlah RM1.8 bilion.

"Justeru itu, kerajaan digesa menubuhkan Inkuiri Awam (public inquiry) bagi menyiasat bencana yang menimpa Sime Darby ini dan kenapa Sime Darby menceburkan diri dalam bidang yang asing baginya," ujar beliau.

Melibatkan wang rakyat

Charles berkata "saya mahu kerajaan mengadakan Inkuiri Awam bagi menyiasat punca sebenar kerugian tersebut. Kerugian ini sesuatu yang serius kerana Sime Darby merupakan Syarikat Berkaitan Kerajaan (GLC) di mana pelaburannya melibatkan wang rakyat dan pembayar cukai."

Beliau berkata, Sime Darby seharusnya menumpukan aktiviti pelaburannya dalam bidang yang mereka ada kepakaran seperti perladangan dan pembangunan hartanah.

"Saya pun hairan kenapa kerajaan menganugerahkan projek Bakun kepada Sime Darby (yang memiliki ekuiti 35%) sedangkan mereka tidak pernah membina empangan," katanya.

Selain dari bidang perladangan dan pembangunan hartanah, Sime Darby terlibat dalam aktiviti permotoran dan jentera berat serta tenaga dan utiliti melalui anak-anak syarikatnya.

Free Malaysia Today sebelum ini melaporkan bahagian tenaga dan utiliti Sime Darby menanggung lebih RM1.8 bilion kos lewat siap projek untuk kerja-kerja awam dan kejuruteraan di Qatar dan Empangan hidro elektrik Bakun.

Bahagian tenaga dan utiliti itu juga mencatatkan kerugian operasi RM110 juta dalam tempoh separuh kedua 2009 berbanding keuntungan sebanyak RM56.3 juta sebelumnya.

Untuk menampong kos yang semakin meningkat kerana kelewatan menyiapkan projek Bakun maka Sime Darby memohon ganti rugi sebanyak RM700 juta daripada kerajaan.

Sime Darby juga terpaksa membuat peruntukan sebanyak RM964 juta meliputi kerugian sebanyak RM200 juta dari projek petroleum Qatar, RM159 juta dari projek Maersk Oil Qatar, RM155 juta dari projek pembinaan kapal-kapal selain dari kerugian sebanyak RM450 juta kos lewat siap projek Bakun.

Ekoran dari bencana kewangan yang ditanggung ini, Presiden dan Ketua Pegawai Eksekutif Kumpulan Sime Darby, Datuk Seri Ahmad Zubir Murshid telah diminta meletakkan jawatan pada Khamis lalu.

Menurut Charles, "Ahmad Zubir tidak sepatutnya dipersalahkan semata-mata disebabkan kegagalan projek-projek itu, namun siasatan lanjut perlu kerana ia merupakan kerugian yang serius dan melibatkan pelaburan wang rakyat.

Projek Kroni Rakyat Jadi Miskin

Ahli Parlimen Klang itu mendakwa dasar-dasar ekonomi kerajaan Umno-BN yang memihak kepada kroni dan hubungan bisnes- politik yang intim membuat rakyat di negara ini menjadi miskin.

Beliau berkata, "ini kerana sejak zaman pemerintahan mantan Perdana Menteri Tun Dr Mahathir Mohamad perkara sedemikian sudah berlaku dan ‘penyakit’ tersebut masih menular sehingga kini.

"Inilah yang terjadi kepada Sime Darby kerana wujudnya bisnes politik dan projek kroni.  Sebab nak tolong kroni, rakyat dan negara jadi miskin," tegas beliau.

Kumpulan Sime Darby dijangka mencatat kerugian buat pertama kali sejak 20 tahun apabila mengumumkan keputusan (untung/rugi) suku tahun pertama pada 27 Mei ini.

MP Kapar terima ancaman bunuh

Ahli parlimen Kapar S Manikavasagam mendakwa menerima ancaman bunuh terhadapnya.

Menurutnya, kertas bertulis "Jangan campur isu pasir. You mati" yang diikat pada beg plastik mengandungi cat merah yang disimbah pada keretanya dan kereta isterinya, lapor Star Online.

Laporan itu memetik Manikavasagam sebagai berkata, tiga beg berisi cat merah itu dibaling dari luar ke arah dua kereta yang terletak di dalam kawasan rumahnya.

Kertas yang mengandungi nota ancaman bunuh itu diikat pada salah sebuah beg plastik berkenaan.

Menurutnya lagi, beliau ternampak kereta yang disimbah cat tersebut pada kira-kira jam 7 pagi selepas bangun pagi.

Laporan itu menyebut, Manikavasagam percaya kejadian itu berlaku selepas ibunya mertuanya masuk tidur kira-kira jam 4 pagi.
Sementara itu Bernama melaporkan Manikavasagam berkata bahawa ini merupakan kejadian pertama sepanjang 10 tahun beliau terlibat di dalamdunia politik dan "saya percaya ia ada kaitan dengan isu pasir yang saya dedahkan".

Menurutnya, kejadian ini tidak akan melemahkan semangat beliau untuk mendedahkan isu penyelewangan pasir yang didakwa melibatkan pegawai atasan Kumpulan Semesta Sdn Bhd, anak syarikat kerajaan negeri yang bertanggungjawab terhadap pengeluaran dan perniagaan pasir di Selangor.

Sebuah akhbar semalam melaporkan bahawa Manikavasagam telah membuat laporan polis di Balai Polis Meru selepas menerima ancaman bunuh terhadap beliau dan keluarganya Jumaat lepas.

Manikavasagam membuat laporan polis mengenai kegiatan rasuah di kalangan pegawai atasan Kumpulan Semesta Rabu lalu selepas beliau diminta oleh Menteri Besar Tan Sri Abdul Khalid Ibrahim berbuat demikian.

Pada pagi hari yang sama beliau bertemu Abdul Khalid untuk mengemukakan aduan rasmi dan menyerahkan dokumen-dokumen berkaitan dakwaan itu.

Berikutan laporan yang dibuat kepada Abdul Khalid, kerajaan Selangor telah merujuk dakwaan rasuah itu untuk disiasat oleh Jawatan Kuasa Pilihan Khas Mengenai Keupayaan, Kebertanggungjawaban & Ketelusan Selangor (SELCAT).

Sementara itu, pemangku Ketua Siasatan Jenayah Selangor ACP Omar Mammah ketika dihubungi berkata siasatan awal mendapati lebih daripada seorang disyaki menyimbah cat di kediaman dan kereta milik Manikavasagam pada awal pagi tadi.

Beliau juga mengesahkan terdapat nota berbau ugutan yang ditemui bersama salah satu daripada tiga bungkusan plastik yang diisikan cat oleh mereka yang melakukan perkara itu.

Omar berkata kejadian ini disiasat di bawah Seksyen 427 dan 507 Kanun Keseksaan.

Ex-MIED chief charged with RM4m cheating

FULL REPORT KUALA LUMPUR: Former Maju Institute of Educational Development (MIED) CEO P Chitirakala Vasu was charged with three counts of cheating to the tune of RM4 million at the Kuala Lumpur Sessions Court this morning.
She claimed trial before judge Azizah Mahamud and has been released on a RM30,000 bail. The case will be mentioned again on June 14.

Chitirakala, 39, of Shah Alam, was charged with cheating former MIC treasurer-general M Mahalingam, 74, who was a director and signatory of MIED Sdn Bhd, by inducing him to sign three cheques for RM1 million, RM1 million and RM2 million.

She is alleged to have deceived him into believing that the payments, which were made to Silver Line Services Sdn Bhd, were loan repayments to one Abdul Rashid Manaf, 64.

The offences were allegedly committed at the MIED, the education branch of the MIC, at Menara Manickavasagam on Jan 9, Jan 30 and May 3, 2007.

If convicted, she faces a maximum 10 years jail and whipping and liability of a fine on each charge.

Deputy public prosecutor Kevin Morais offered bail of RM30,000 in view of the huge amount involved and the seriousness of the offence.

Defence counsel Saseedharan Menon asked for lower bail, saying that Chitirakala had assisted the police in their investigation but Morais said he had received a report which said that Chitirakala was uncooperative and did not present herself during the investigation.
Arrested yesterday
She was arrested yesterday by the Malaysian Anti-Corruption Commission (MACC) over this matter.

She had been under investigations following a police report lodged by MIC officials for alleged criminal breach of trust amounting to RM5.25 million.

Chitirakala, a former blue-eyed girl of MIC president S Samy Vellu, had a fallout with the veteran leader following alleged misappropriation of funds from the Maju Institute of Educational Development.

She was the chief executive officer of MIED, an education arm of MIC which was involved in giving out scholarships for needy Indian students as well as the main body which oversaw the party's Aimst University.

The party had then lodged a police report over the missing funds as well as missing MIED files.

This was the followed by the removal of the party's long serving treasurer Mahalingam, who was a MIED cheque signatory.

Ketua AMK Sibu keluar parti satu pembohongan.

Beliau menyifatkan berita itu sengaja direka akibat tindakan terdesak Barisan Nasional untuk memenangi pilihan raya kecil Sibu 16 Mei ini.


"Dia bukan Ketua AMK Sibu. Umurnya sahaja sudah 42 tahun. Ini adalah taktik lapuk dan usang yang dilakukan BN menunjukkan mereka semakin terdesak untuk menang pilihan raya kecil ini," katanya kepada Suara Keadilan.

Bernama melaporkan Isnin lalu Ketua AMK Sibu, Jee Chang Peng, 42, keluar parti dan bercadang untuk menyertai parti komponen BN.

Menurut Shamsul Iskandar, berita itu sengaja diadakan bagi melemahkan pengaruh Pakatan Rakyat Sarawak yang kini semakin kuat dan bakal memberikan saingan sengit kepada BN pada PRK itu.
"Di Sibu bukan KEADILAN yang bertanding tetapi DAP. Tetapi mereka melakukan ini untuk longgarkan kesepakatan dalam Pakatan Rakyat. Perkara ini tidak sedikit pun melemahkan kita dan kita semakin yakin untuk menentang mereka," ujarnya.

Saiful: Najib terkejut dengan pendedahan saya

Mahkamah Tinggi Kuala Lumpur hari ini mendengar keterangan saksi utama yang juga pengadu kes berkenaan, Mohd Saiful Bukhari Azlan berhubung pertemuannya dengan timbalan perdana menteri ketika itu, Datuk Seri Najib Razak pada 24 Jun, 2008.

Pertemuan itu diadakan dua hari sebelum Saiful mendakwa yang dia diliwat oleh ketua pembangkang, Datuk Seri Anwar Ibrahim.

Dalam keterangannya selama sejam pada perbicaraan di Mahkamah Tinggi Kuala Lumpur, hari ini, Saiful juga memberi butiran berhubung pertemuannya dengan ACP Rodhwan Mohd Yusof (sekarang SAC 1) dan kemudiannya dia membuat panggilan telefon kepada Ketua Polis Negara, Tan Sri Musa Hassan sehari sebelum kejadian berkenaan.

Saiful juga menceritakan pertemuannya dengan bekas Ketua Pemuda PKR, Ezam Mohd Noor (kanan) (sekarang ini Senator) di Rawang, sehari selepas kejadian berlaku ( 27 Jun) bagi mengadu kepadanya berhubung “penganiyaan” oleh Anwar.
Saiful, 25, saksi utama pihak pendakwaan dalam perbicaraan kes liwat ketua pembangkang itu berkata beliau dibawa oleh rakannya bernama Rahimi dan juga pakciknya bernama Tuah Mohamad untuk berjumpa Ezam di rumahnya di Bandar Tasik Puteri, Rawang.

Ketika pemeriksaan balas oleh peguam Karpal Singh yang mewakili Anwar, sama ada beliau mengenali Mohamad Ezam sebelum itu, Mohd Saiful berkata beliau hanya kenal Mohamad Ezam begitu sahaja sebagai kawan.

Bekas pembantu kepada Anwar itu berkata pertemuan dengan Ezam pada lewat malam 27 Jun itu hanya berakhir keesokan paginya.

Kedua-dua Rodhwan dan Musa pula, adalah 'watak utama' semasa perbicaraan Anwar pada 1998 yang menyaksikan ketua umum PKR itu dipenjarakan. Anwar kemudiannya dibebaskan oleh Mahkamah Rayuan.
Kepada soalan lain oleh Karpal adakah Musa ada menghubungi beliau, Saiful menjawab beliau yang menghubungi Musa.
Karpal: Kenapa telefon dia?

Saiful: Nak mengadu masalah saya.

Karpal: Banyak masalah bukan?

Saiful: Memang saya banyak masalah.

Karpal: Ada jumpa dia?

Saiful: Contact (hubungi) sahaja.

Karpal: Bila?

Saiful: Pada 25 Jun 2008, sebelah pagi.

Karpal: Kamu contact dia untuk ceritakan masalah kamu bukan?

Saiful: Ya, tapi saya hanya bercakap selama seminit dan dimarahi oleh KPN kerana mungkin dia ingat panggilan main-main dan beliau meletakkan telefon. Beliau juga mengingatkan saya untuk tidak menelefonnya lagi.

Disoal-siasat lagi oleh peguambela utama, Karpal Singh setelah permohonannya agar prosiding ditangguhkan ditolak, Saiful berkata dia dibawa ke kediaman persendirian Najib di Taman Duta, Kuala Lumpur oleh pembantu khas timbalan perdana menteri itu, Khairil Anas.

“Saya pergi ke rumah Khairil Anas bagi mengadu perkara itu. Dia kemudiannya memutuskan untuk membwa saya berjumpa dengan Najib di rumahnya di Taman Duta,” kata Saiful.

Saiful juga pernah mendakwa selain diliwat pada 26 Jun 2008, dia juga beberapa kali telah diliwat pada tarikh lain oleh Anwar.

Menurut Saiful, mereka tiba di rumah Najib selepas solat Maghrib, lebih kurang jam 8 malam dan dia menghabiskan kira-kira 20-30 minit menceritakan masalahnya itu kepada timbalan presiden Umno itu.

“Najib (kiri) terperanjat dengan pendedahan tentang apa yang berlaku (insiden Saiful diliwat Anwar),” katanya sambil menambah perbincangan malam itu membabitkan dirinya, Khairil dan Najib.

Ditanya Karpal sama ada Najib menawarkan sebarang nasihat, Saiful menjawab - tidak.

Saiful juga memberitahu mahkamah sebelum pulang dia ada terjumpa isteriNajib, Datin Seri Rosmah Mansor tetapi tidak berjumpa secara peribadi.

Liwat II: Mahkamah tolak permohonan Karpal

Mahkamah Tinggi Kuala Lumpur hari ini menolak permohonan peguam Karpal Singh bagi mendapatkan kenyataan beramaran daripada pengadu Mohd Saiful Bukhari Azlan yang diberikannya kepada polis.

Hakim Datuk Mohamad Zabidin Mohd Diah, berkata tidak adapercanggahan dalam keterangan Saiful kepada polis dan keterangannya di mahkamah, dan terpulang kepada peguam negara untuk menetapkan pertuduhan terhadap seseorang itu.

"Walaupun terdapat percanggahan dalam laporan polis dan pengakuan saksi. Namun kenyataan saksi tidak konflik dengan kejadian. Berdasarkan hujah itu, permohonan Karpal ditolak,” katanya.

Semalam, peguam utama tertuduh, Datuk Seri Anwar Ibrahim - Karpal memberitahu mahkamah bahawa pihak pembelaan memerlukan keterangan itu kerana terdapat percanggahan antara keterangannya kepada polis dan pertuduhan liwat yang dikenakan terhadap Anwar.
 
Karpal berkata Saiful, dalam keterangannya kepada polis dan
keterangannya di mahkamah, menyatakan dakwaan liwat itu dilakukan tanpa kerelaannya manakala pertuduhan yang dikenakan terhadap Anwar mengikut Seksyen 377B Kanun Keseksaan adalah persetubuhan yang dipersetujui.

Hakim kemudiannya mengarahkan perbicaran disambung.
Karpal tidak berpuas hati dan kemudiannya memohon supaya prosiding ditangguhkan supaya rayuannya itu boleh dikemukakan kepada mahkamah yang lebih tinggi.

“Kita mempunyai masa dari sekarang hingga akhir bulan untuk memujuk Mahkamah Rayuan memberikan tarikh awal.,” katanya.

Bagaiamanapun, Peguam Cara Negara II, Datuk Mohd Yusof Zainal Abiden dan berkata perbicaraan perlu diteruskan dan rayuan boleh dikemukakan selepas mahkamah selesai bersidang.
Pertikaman lidah berlaku dan Karpal mendakwa Mohd Yusof sudah mengetahui keputusan hakim yang menolak permohonan Karpal bagi mendapatkan kenyataan beramaran daripada pengadu Mohd Saiful Bukhari Azlan yang diberikannya kepada polis.
Ini kerana beliau datang dengan persediaan berkenaan. 

Selepas rehat seketika, hakim memutuskan tidak ada tindakan menghina mahkamah akan dikenakan ke atas Karpal berhubung kenyataannya itu.
Perbicaraan bersambung dengan giliran Saiful disoal-balas.

Saiful, 25, mendakwa Anwar, 63, meliwatnya di Unit 11-5-1 Kondominium Desa Damansara, Jalan Setiakasih, Bukit Damansara, di sini antara 3.01 petang dan 4.30 petang pada 26 Jun 2008.

Pertuduhan itu membawa hukuman penjara sehingga 20 tahun dan sebatan jika disabit kesalahan.

KSSB: MP Kapar 'dikunjungi' SPRM

Empat pegawai Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) 'mengunjungi' ahli parlimen Kapar S Manikavasagam ekoran dakwaannya berhubung penyelewengan dalam Kumpulan Semesta Sdn Bhd (KSSB).

Dalam kunjungan kira-kira 45 minit pada jam 10.30 pagi tadi di pejabatnya di pekan Kapar, SPRM meminta Manikavasagam memberikan kerjasama dan menyerahkan dokumen berkaitan kepada mereka.

Manikavasagam ketika dihubungi mengesahkan kunjungan tersebut.

Beliau bagaimanapun mengakui enggan memberikan sebarang kerjasama kepada suruhanjaya itu kerana "tidak percaya kepada SPRM"

Kematian Aminulrasyid: Koperal didakwa di mahkamah

Seorang anggota polis didakwa di mahkamah hari ini kerhubung kematian adik Aminulrasyid Amzah pada 26 April lalu.

Anggota polis berpangkat koperal itu, dihadap di Mahkamah Sesyen Shah Alam pada kira-kira jam 12 tengahari ini.
Koperal Jenain Subi, 48, dituduh menyebabkan kematian dengan cuai mengikut Seksyen 304A Kanun Keseksaan.
jika sabit kesalahan, dia berdepan hukuman 20 tahun penjara.
Jenain tidak mengaku salah terhadap tuduhan dan minta dibicarakan.
Hakim M Gunalan membenarkan Jenain diikatjamin RM10,000 dengan seorang penjamin.
Sebelum itu, Jemain tiba di premis mahkamah pada jam 11.35 pagi dengan dikawal ketat oleh sepasukan anggota polis yang berpakaian biasa.

Kurang korum hakim, habeas corpus sultan ditangguh

Permohonan habeas corpus di Mahkamah Khas untuk "membebas" Sultan Kelantan yang dijadualkan didengar hari ini, ditangguhkan kerana korum hakim tidak mencukupi.

Liwat II: Karpal soal balas Saiful

Perbicaraan kes liwat ll Datuk Seri Anwar Ibrahim disambung hari ini, selepas tiga bulan ditangguhkan, dengan peguambela Karpal Singh menuntut senarai saksi.
12.30tghari: Karpal Singh memohon penangguhan hingga pagi esok untuk membuat penghujahan penuh bagi mendapatkan kenyataan beramaran Saiful.

Hakim Zabidin membenarkannya dan menanguhkan perbicaraan hingga esok.
11.30pagi: Karpal minta rihat sekejab.
11.25pagi: Karpal memohon supaya kenyataan beramaran Saiful dikemukakan, dengan berkata saksi tersebut tidak bercakap benar.

11.22pagi: Saiful mendakwa, minyak pelincir digunakan sewaktu melakukan hubungan seks.

11.20pagi: Karpal, merujuk kepada laporan Hospital Kuala Lumpur, berkata tiada tanda parut atau kecederaan terbaru pada diri Saiful.

Saiful pula berkata dia tidak tahu kerana dia tidak dapat melihat duburnya.

11.06pagi: Karpal membaca salinan laporan yang menyatakan punca kesakitan Saiful adalah kerana kemasukan satu objek plastik ke dalam duburnya.

Saiful berkata laporan itu salah dan tidak betul.

Berikutan itu, Karpal berkata doktor berkenaan akan dibawa untuk memberi keterangan.

Saiful berkata dia tidak tahu dan "mungkin doktor berbohong".
10.54pagi: Karpal bertanya Saiful sama ada dia seorang muslim yang baik. Saiful menjawab iya.

Karpal berkata Saiful tidak memahami ajaran Islam kerana dia tidak mandi junub selepas melakukan hubungan seks.

Saiful mengakui dia tidak berbuat demikian selepas melakukan hubungan seks dengan Anwar kerana dia dalam keadaan darurat pada masa itu

Saiful berkata dia mandi sebelum pergi mengerjakan solat Jumaat.

10.45pagi: Saiful berkat dia tidak bertemu dengan Najib atau isterinya Rosmah Mansor sebelum pertemuan pada 24 Jun.

Saiful berkata dia berjumla ASP Rodhwan di Hotel Mulia pada malam 24 Jun

selepas pegawai polis itu menghubungi bertanyakan mengenai masalahnya.

10.40pagi: Saiful berkata dia berjumpa PM Najib pada 24 Jun 2008 di kediaman Najib di Jalan Duta untuk mengadu masalahnya.

10.39pagi: Karpal meminta Saiful mengangkat sumpah dengan betul dan memintanya bercakap benar.

10.35pagi: Hakim Datuk Mohd Zabidin Md Diah menolak usaha Anwar untuk mendapatkan senarai saksi ekoran keputusan mahkamah rayuan dan mahkamah persekutuan menolak permohonannya sebelum ini.
Sesi soal-balas ke atas Saiful.
10.14pagi: Karpal bertanya mengapa pihak pendakwa begitu takut untuk menyerahkan senarai saksi kepada pihak pembela.

Katanya, jika tiada sebarang konspirasi untuk menjatuhkan Anwar, maka pihak pendakwa sepatutnya menyerahkan senarai saksi kepada pihak pembela.

10.06pagi: Peguamcara Negara 11 dan ketua pasukan pendakwa, Datuk Mohd Yusof Zainal Abidin berkata beliau terikat dengan keputusan Mahkamah Persekutuan supaya tidak menyerahkan senarai tersebut, dengan berkata senarai saksi itu "mungkin" diberikan diakhir pendakwaan.

Mohd Yusof berkata beliau tidak nampak hubungan antara soal-balas dengan senarai saksi.

Menurutnya lagi, daripada keterangan Saiful, pihak pembela sudah boleh mengagak siapakah saksi-saksi berkenaan.

Karpal, bagaimanapun, berkata beliau mahu mahkamah menggunakan kuasanya mengikut Seksyen 56 Kanun Prosedur Jenayah untuk memaksa senarai saksi itu diserahkan.

Karpal juga mengadu tidak mendapat nota keterangan.
9.57pagi: Peguambela Karpal Singh mahu mahkamah memastikan mereka mendapat senarai saksi sebelum bermula sesi soalsiasat Mohd Saiful Bukhari Azlan.

Beliau berkata, pihak pembela perlu tahu sama ada saksi mereka mungkin turut ada dalam senarai saksi pendakwa.

Rosli Dahlan’s Trial : The Liar Kevin Morais, Deputy Director of Prosecution of MACC buried in his lies!

This morning I wrote a short piece about the lies perpetuated by the guardians of our institutions in newspapers, in parliament and even in the courts. I promised to report about Rosli Dahlan’s trial specifically because the mainstream media (MSM) have blacked out everything about this case. The reason why the MSM is doing a black out is quite simple. PDRM’s image as the principal law enforcement agency cannot be redeemed for so long as  Musa Hassan is IGP. PDRM is a lost cause for now especially with the point blank shooting of 15 year old  school boy, Amiruldin.

The government needed a law enforcement agency with some credibility that can be used to attack the opposition as well as to stem the people’s frustrations with all the ills that is plaguing the country. Even sleepy head Abdullah Badawi realised that. So, they rebranded the ACA and called it the MACC, and rushed the MACC Act through Parliament. As in every rushed job, the leakages and defects started to show soon enough. In the case of the MACC, that it has become a monster is evident almost immediately. The MACC was used to bring down the PR Perak state government. The people were upset. Then Teoh Beng Hock was killed while in the MACC’s custody. The people became angry. To add insult to that death, the MACC tried to cover it up. The people are enraged. Confidence in the MACC is as good as gone.

In that context, the Rosli Dahlan’s trial would expose the truth about the MACC. The facts and evidence would show that the MACC has become more rotten than PDRM. The government cannot afford that. The MACC cannot afford that. So the best way is to black any news about it as the expose’ in this case would put to waste all the PR efforts and the huge sums of money spent to rebuild the MACC’s image. And that is what I saw this morning observing the court proceedings from the public gallery.

During the previous trial days in December 2009 and January 2010, the Deputy Director of Prosecution of the MACC, Anthony Kevin Morais, was already exposed as a liar. He twisted and turned on much of his testimony. When twisting and turning dug him into a deeper hole, he became evasive. This morning, upon realising that he cannot forever be evasive in answering questions from Rosli’s counsel, he used his subordinate, DPP Zulqarnain who conducted the case, to shield him from Dato’ Kumaraendran’s penetrative questions.

The trial started with DPP Zulqarnain making a lengthy legal submission as to why Dato’ Kumaraendran should not be allowed to continue with the cross examination of Kevin Morais . DPP Zulqarnain quoted extensively Sarkar on Evidence, which according to him was the mother of all books (which made him sound like a losing Saddam Hussein), as to why Kevin should not be further punished as he had already spent 3 days on the witness stand. This invited a sharp retort from Dato’ Kumaraendran that DPP Zulqarnain was being disrespectful to the court by delivering his unsolicited lecture. Dato’ Kumaraendran also said that Kevin had only himself to blame for twisting and turning resulting in one question becoming ten questions, and which eventually became a tighter noose around the lying veins in his neck.

Judge Abu Bakar Katar must have been revolted by the childish antics of these two senior MACC DPPs that he ordered the trial to proceed without wasting any more time. When asked if he was aware that in Dato’ Ramli’s trial Judge Gunalan had found that the s. 32 Notice issued against Dato Ramli to be bad in law, Kevin started a series of his evasive  replies by answering  “Tak Tahu” to all the questions. Kevin must have practised “Tak Tahu” like a parrot that he also answered “Tak Tahu” when asked if he knew that Dato’ Ramli had been acquitted by that court. This provoked Dato’ Kumaraendran to ask “You tak baca surat khabar kah?” to which he again answered “Tak tahu”. Dato Kumarendran sarcastically retorted “ Apa you tak tau baca kah?” and the reply was  again “Tak Tahu”! The gallery burst out laughing!

Dato’ Kumaraendran then methodically asked Kevin a series of more penetrating questions which showed that if Dato’ Ramli has been fully acquitted without his defence being called, and if there is no predicated offence by the principal actor, how could a subsidiary charge against Rosli be sustainable? Suddenly, Kevin’s amnesiac “ Tak Tahu” ended with an arrogant reply – “We have appealed, so the charge against Rosli can still proceed!”. A very intelligent and firm reply indeed.

However, to the observers at the public gallery, Kevin’s answers were so ridiculous. Here was the Deputy Director of Prosecution of the MACC appearing as a witness saying that he did not know what was said by the other witnesses in Dato’ Ramli’s trial. Here was the Deputy Director of Prosecution of the MACC saying that he did not know what was said by and the findings of the Judge in Dato’ Ramli’s trial. Here was the Deputy Director of Prosecution of the MACC being contemptuously evasive and he was tolerated by the Court. Here was the Deputy Director of Prosecution of the MACC who simply can’t be bothered with the consequences of his actions. He couldn’t be bothered that he had destroyed the life and family of innocent citizens. And how do we justify entrusting into the hands of  people like Kevin Morais the valuable institutions of our country?
Kevin’s conduct was simply repulsive. When asked about Rosli’s unlawful arrest; how his office was stormed; the brutality he suffered; his bloodied wrist; why he was not allowed to lodge a police report and seek medical attention; why his wife and children were refused access to see him; why he was thrown into lock-up on a Ramadan night; what is the urgency of charging Rosli one day before Hari Raya 2007, Kevin couldn’t be bothered. He was not bothered that the charge against Rosli was not for corruption. He was not bothered that none of the information connected Rosli to any wrong doing.

All he was bothered was that he carried out his instructions. And his instructions came from his superior, Dato’ Nordin Hassan, that Rosli had acted for and rendered assistance to Dato’ Ramli. That Rosli was the stumbling block to the conspiracy by IGP Musa Hassan and A-G Gani Patail to use the MACC to bring down and eliminate Dato’ Ramli from PDRM. As a stumbling log, therefore Rosli Dahlan must also be brought down.

That was the biggest mistake Kevin made. In the next sweeping questions, Dato’ Kumaraendran exposed that Dato’ Nordin Hassan too had benefitted from Rosli’s services. That in 1998 Dato’ Nordin Hassan had asked Rosli to act in a long unresolved family dispute over land inheritance dating back to 1956. That in 2000, Rosli Dahlan had secured payment from the government amounting to RM 6.5 million and then distributed that money to Dato’ Nordin Hassan’s family under the terms of a Settlement Agreement. That begets the question, how was it that when Rosli rendered services resulting in recovery of RM 6.5 million for the family of Dato’ Nordin Hassan, Rosli was said to be acting perfectly legal? How was it that when Rosli rendered legal services to Dato’ Ramli Yussuff over similar Islamic Hibbah and estate planning matters, suddenly Rosli became a crooked lawyer? This is something for Dato’ Abu Kassim and the MACC Advisory Panel to ponder on.

The next part of the trial saw both DPP Zulqarnain and Kevin Morais ferociously trying to block any questions relating to Dato’ Nordin Hassan. Why were they shielding Dato’ Nordin Hassan? Word has it that Dato’ Nordin Hassan is eyeing the A-G’s post after Gani Patail steps down. Word in Kevin Morais’ close circle is that he expects to be elevated to be a High Court Judge. Therefore, if you are in the Judicial and Legal Service, you will need friends in high and powerful places. How do you think VK Linggam was caught on tape lobbying for such positions for his allies and friends. Because that is how things work in Malaysia!

That is what I want Malaysians to know and realize – that we need upright and incorrupt intellectuals leading our public institutions. Not mediocre characters who cannot stand on their own merits. The case of Dato’ Ramli and Rosli Dahlan is a study in the contrast. Compare the achievements of Dato’ Ramli against Musa Hassan and we see that contrast.

As for people like Kevin Morais, he must be exposed so that he can never helm any high public office or institutions which require the highest integrity. I hope that Judge Abu Bakar Katar would expose Kevin Morais for the liar that he is throughout this trial. Judge Abu Bakar Katar needs to only see how Judge Gunalan had discredited Kevin’s notice as invalid against Dato’ Ramli Yusuff. He should be as courageous as the Sabah  Judge Supang Lian, who had denounced IGP Musa Hassan as an incredible witness whose testimony is not to be  believed, and denounce Kevin as a liar and bury him with all his lies.”

Zaid Ibrahim : Beza arahan dan pandangan peribadi

Sultan Selangor telah bertitah bahawa masjid tidak boleh digunakan untuk tujuan politik. Titah itu luas sekali skopnya. Saya yakin baginda berniat ikhlas dan jujur tetapi tafsiran titah itu mungkin diambil kesempatan oleh pihak-pihak tertentu.

Titah itu perlu diambil kira dalam konteks Perlembagaan Persekutuan dan kuasa-kuasa raja. Contohnya, apakah doa yang disambut oleh semua mukmin supaya “raja kita sanjung dan dipanjangkan umur” itu sebenarnya tidak bersifat politik? Kadang-kadang kita dengar dalam khutbah rasmi solat Jumaat yang memuji-muji kerajaan Barisan Nasional. Apakah itu bukan politik?

Titah itu adalah pendapat peribadi baginda. Ia bukan arahan, perintah atau “decree”. Dalam sistem Raja Berpelembagaan, sultan tidak boleh mengeluarkan arahan atau perintah seperti zaman raja-raja Melaka dahulu. Menurut Perlembagaan, apa-apa kehendak baginda mestilah disalurkan melalui Majlis Agama Negeri yang bermesuayarat dan keputusan mesyuarat itu akan diwartakan atau dijadikan “gazette” tentang apa-apa peraturan yang dikira perlu seperti mengeluarkan fatwa yang sah dan sebagainya. Pendapat sultan hanyalah pandangan peribadi. Sekurang-kurangnya ia boleh dianggap sebagai nasihat yang baik – untuk semua pihak, bukan bagi mana-mana individu atau kumpulan sahaja.

Jadi tak timbul soal Tok Guru Nik Aziz melanggar arahan Sultan Selangor seperti yang didakwa oleh Perdana Menteri Najib Razak. Tok Guru dan ramai lagi orang Islam yang tak sependapat dengan pendirian peribadi Sultan Selangor. Pada zaman sekarang dan mengikut Perlembagaan, tak sependapat hanya bererti berbeza pandangan. Ia bukan satu kesalahan. Ia juga bukan perbuatan menghina.

Lainlah pula bila Sultan Pahang menitahkan supaya Kartika Sari Dewi tidak perlu dirotan; ia adalah keputusan yang sah kerana baginda ada kuasa di bawah Enakmen Pentadbiran Agama Islam Negeri untuk berbuat demikian. Itu pun ramai yang membantah dan melenting, malah ada yang mengkritik keputusan Sultan Pahang, termasuk dari Persatuan Peguam Syarie Malaysia.

Jadi mengapa Najib tidak membela Sultan Pahang atas keputusan baginda yang sah dari segi undang-undang tetapi hanya mahu membela Sultan Selangor walaupun itu hanya pendapat peribadi?

Sebabnya, politiklah. Bila Sultan melakukan sesuatu yang nampak menguntungkan UMNO, maka mesti Najib bela. Sepatutnya Perdana Menteri mesti faham perbezaan antara perintah dan arahan, dengan pendapat dan pandangan peribadi, dalam konteks Perlembagaan Persekutuan. Barulah rakyat terutamanya orang Islam tidak mudah dipesongkan dengan dakyah politik.

Then and now: the Ezam story



Ezam said they went to great lengths to persuade him to change sides. When they failed, they compromised by agreeing that he remains in the opposition as long as he agreed to abandon Anwar. When they failed to also do this, he was packed off to Kamunting to start serving his two-year detention.

The ex-PKR Youth Leader, Ezam Mohd Nor, has been going round the country giving ceramahs during the many by-elections. At these ceramahs, he whacked Anwar Ibrahim and claimed that he knows all sorts of secrets about Anwar.

Ezam used to say he had six boxes of secrets about Tun Dr Mahathir Mohamd in his safekeeping and that one day he would reveal all these secrets.

That was more than ten years ago and until today we have not seen a single piece of paper from those six boxes.

Yesterday, it was announced that Ezam is now a Senator. This is probably his reward for all the Anwar-bashing that he had done.

Of late, what Ezam has been saying contradicts what he said back in the days before he left PKR to join Umno. Maybe you can read what he said on 27 June 2003 (below) and compare what he said then to what he is saying today.

Maybe Ezam thought Malaysians have short memories.

Palanivel, Ezam and two others to be made Senators

MIC deputy president Datuk G. Palanivel is among four people who will be made Senators.

The others are former PKR youth chief Ezam Mohd Nor, Rahim and Co executive chairman Datuk Abdul Rahim Abdul Rahman and Pagoh Wanita Umno chief Noriah Mahat.

Umno tried to buy Ezam over

The National Justice Party Youth Leader, Ezam Mohd Nor, has admitted that Umno sent him feelers while he was in prison.

Speaking to a crowd of about 500 supporters at the home of party President, Dr Wan Azizah Wan Ismail, Ezam said, first they separated him from the rest of the Reformasi Six so that they could get him alone. Once he was isolated from the rest, they worked on him to try to woo him over.
Ezam said he was quite surprised at the speed his Official Secrets Act (OSA) trial developed. Ezam was then already under Internal Security Act (ISA) detention in the Kamunting Detention Camp together with Saari Sungib, Tian Chua, Dr Badrulamin Bahron, Lokman Noor Adam and Hishamuddin Rais.

Once the conviction was secured, Ezam was immediately transferred to the Kajang Prison to start serving his two-year jail sentence, the first time in the 43-year history of the ISA that a detainee had to simultaneously serve both an ISA detention and a jail term.

Then Ezam realised why they had hurriedly separated him from the rest for, once he was isolated, Umno made its move to try to woo him over.

Ezam said he received all sorts of approaches from Umno asking him to switch camps and abandon his “struggle to free Anwar Ibrahim from jail”.

In fact, said Ezam, his entire initial 60-day detention under the ISA, before he was sent to Kamunting, was centred on Anwar Ibrahim and not once was he interrogated about his alleged “crimes”.
Ezam and nine other party leaders and Reformasi activists were detained in April 2001 for allegedly being a threat to national security. According to the official statement released by the government, they had conspired to topple the government through violent and militant means and were involved in a plot to bring in bombs, guns, grenade launchers and Molotov Cocktails.

However, the entire 60 days interrogation was on party matters and the police tried to convince Ezam to abandon his struggle and rejoin Umno. After failing to woo him over, the police finally tried to persuade Ezam to just abandon Anwar Ibrahim.

Ezam said, the police told him he could remain in the National Justice Party and continue to oppose the government. However, he must not mention Anwar’s name in any of his speeches. In short, Ezam may continue his opposition party activities but these should not include the struggle to free Anwar.

Ezam also said they tried to convince him that Anwar was in fact guilty of all the sexual crimes he was alleged to have committed and that the police had all the evidence to support these charges.
“Until the last day of my 60-day detention the police never once produced this evidence,” said Ezam.
“When I asked them on the last day of my detention, the day before I was transferred to Kamunting, where this so-called evidence was, they replied that it was of no use showing me this evidence as I would not believe it anyway.”

Ezam said rumours are rife that he is in the midst of making a deal with Umno. “Why should I do this now?” asked Ezam.

“If I want to this, why do this now? I should have done it at the early stages of my detention. Why should I suffer the two year detention and the OSA conviction where I have already served 10 months of my 16-month jail term?”

Ezam said he took a great risk by applying for bail.

“I have already served 10 months of my conviction,” explained Ezam.

“No doubt I was sentenced to two years jail. However, after a one-third remission, I only need to serve 16 months of this sentence.”

“My lawyers were surprised when I told them I would like to apply for bail. They cautioned me that if I fail in my appeal, the ten months I have already served would not be taken into consideration and I would have to start serving the 16 months jail sentence all over again.”


“I would therefore lose these 10 months. But, as a politician, this is the risk I have to take,” Ezam said to the crowd that broke out into thunderous applause.

Ezam then revealed that his release and that of the other five was due to a power struggle within Umno.

“It is because of the serious power struggle within Umno that I and my five comrades were released.”
“One group in Umno was opposed to our release. However, there was another group that wanted us released.”

It is said that Malaysian Prime Minister Dr Mahathir Mohamad was the one behind their release while the Abdullah Ahmad Badawi camp tried to block their release.

These next four months are very critical to Umno as Dr Mahathir would be leaving office in October with Abdullah supposed to take over. The last thing Abdullah wants is the Reformasi Six back in circulation where they could do much damage to Umno that is yet to settle the succession issue.

Talk amongst the Umno circles is that Dr Mahathir wants the Reformasi Six to “stir the pot” to put pressure on the party. It is hoped that this may then be too much for Abdullah to handle and there would be serious doubts raised as to whether he would be able to take over from Dr Mahathir.

For all intents and purposes, say the sources within Umno, the Reformasi Six were released so that they could become the bogeymen. Umno would then question whether Abdullah is strong enough to fend off the opposition onslaught or should Dr Mahathir stay on to save Umno.

Whatever theories one may subscribe to, the immediate and unconditional release of the Reformasi Six took everyone by surprise, the Reformasi Six included. No doubt, there was much pressure from the International community, foreign governments and Malaysia’s Human Rights Commission to release them. In fact, even the Kamunting Review Board and the Federal Court ruled that their detentions are illegal, mala fide and violated the constitution. However, it cannot be discounted that Umno’s internal affairs also had a bearing on their release.
